Customer Marketplace Agreement

PHP-Fusion Inc (hereinafter referred to as "PHP-Fusion") AND you (hereinafter referred to as "Customer") HAVE entered into a Customer Master Agreement ("Agreement") effective from January 1, 2018 of which this "Marketplace Agreement Extension" is a part. 1. Conditions Of Use PHP-Fusion provide Addons to you in agreement with the following conditions. If you purchase from our Marketplace at PHP-Fusion you accept these conditions. Please read these conditions carefully. PHP-Fusion controls and operates this site from its offices within Malaysia. The laws of Malaysia relating to including the use of this site and materials contained. If you choose to access from another country you do so on your own initiative and are responsible for compliance with applicable local regulations. Please review our other policies posted on this site, such as the Code of Conduct (CoC). These policies also govern your visit to PHP-Fusion 2. Ordering Whilst all efforts are made to ensure accuracy of description, specifications and pricing there may be occasions where errors arise. Should such a situation occur PHP-Fusion cannot accept your order. In the event of a mistake you will be contacted with a full explanation and a corrected offer. The information displayed is considered as an invitation to treat not as a confirmed offer for sale. The contract is confirmed upon delivery of your order. 3. Delivery service We try to make the delivery process as simple as possible when it comes to to provide you with your ordered Addon(s) Delivery times are based on the selected payment gateways callback script for payment verification, once verified our system prepares your download We aim to deliver within 1 minute from the paid order, however sometimes due to high order volumes on certain hours it can be delayed. Please allow at least 10 minutes before contacting us with a suspected error. We will attempt to email you if we become aware of an unexpected delay. Each item will be attempted to be delivered instantly. 4. Copyrights All content includes on the site such as text, graphics logos button icons images audio clips digital downloads and software are all owned by PHP-Fusion and/or it´s respective owners whom are protected by international copyright laws. 5. License and usage PHP-Fusion grants you a limited license to access and make personal use of your purchased Addon(s) under the Enduser PHP-Fusion Addon License. This license doses not include any resale rights or other sharing options of your purchased Addon(s). Your purchased Addon(s) are strictly regulated by the terms of our Enduser PHP-Fusion Addon License. 6. Product Descriptions PHP-Fusion attempt to be as accurate as possible, however we do not warrant that product descriptions or other content is accurate complete reliable, or error free. From time to time there may be information on PHP-Fusion that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing and availability. We reserve the right to correct any errors inaccuracies or omissions and to change or update information at any time without prior notice. We also reserve the rights to do these changes even after you have submitted your order. 7. Prices Prices and availability of Addons are subject to change without notice, the prices advertised on this site are for orders placed and includes VAT. 8. Privacy and Security Notice This policy covers all users who make a purchase from PHP-Fusion. It is not necessary to purchase anything in order to gain access to the some of the free services we have here on PHP-Fusion. We have taken the appropriate measures to ensure that your personal information is not unlawfully processed. PHP-Fusion uses industry standard practices to safeguard the confidentiality of your personal identifiable information, including good security and very limited access to customer related data. During the payment process, we ask for personal information that both identifies you and enables us to communicate with you. We reserve the option to use the information you provide only for the following purposes. To send you newsletters and details of offers and promotions in which we believe you could be interested. To improve the content design and layout of the website. To understand the interest and buying behavior of our registered users To perform other tasks such as general marketing and promotional focused on our products and activities. 9. Terms for Commercial Addons You accept and understand that PHP-Fusion will pay you your accumulated sales only once per month. You accept and understand that you need to provide us with the correct PayPal email address in the section field "Payout to this email" for each Addon. You accept and understand that PHP-Fusion will charge 20% on sales from your Addon price for each closed sale. You accept and understand that we only approve Commercial Addons that follows the Enduser PHP-Fusion Addon License (EPAL), found in our Licenses Section. You accept and understand that CoC violation´s of a severe nature that results in a ban of your accout will halt all payouts to you. This includes both accumulated sales and future sales. You accept and understand that a valid PayPal address is required. PHP-Fusion does not take any responsibility if you do not have a valid PayPal account upon payment. All Commercial Addons must contain one copy of epal.txt, found in our Licenses Section. 10. Support When purchasing Commercial Addon´s the respective author is primarily responsible for the support for their Commercial Addon´s. While we do encourage authors to provide free support (and so to generate better sales for themselves), the reality is that authors are not required to provide support and it is also their choice. What we try and do is give the buyer as much information as possible regarding each item prior to purchasing and test the file thoroughly before we approve it for sale. Naturally, on popular Addons there can also be some members who are willing to give people a hand if they are familiar with the Addon. 11. Non-Returnable If you have purchased an Addon and it does not work as described or is faulty, please use the forum for the Addon and tell us exactly what the problem has been with the Addon. This way the Addon can be either fixed or you can be guided in how to resolve the issue. Before anything else, please read the comments that belong to the Addon(s) dedicated Support Forum – there is a good chance someone else may have had the same problem as you and the author might have already addressed the issue. Also make sure that you thoroughly read all of the Addons documentation in case there is an existing answer to your issue. Note : Because of the nature of digital goods, we can unfortunately not issue a refund or exchange it. 12. Final Terms and Acceptance 1. Customer Election. Customer hereby elects to activate the Marketplace services through PHP-Fusion. 2, Customer Election PHP-Fusion and you mutually agree and understand that PHP-Fusion's terms and conditions are subject to change without the need for your consent at anytime before, during or after the purchase. 3. PHP-Fusion's Acceptance. PHP-Fusion hereby accepts Customer's election to activate Use the Marketplace services through PHP-Fusion.
